Winning cases is exactly what our clients want us to do. As a result, clients frequently ask about our win/loss record. We were tempted to publish a running tally of the cases we won and lost, but Rule 7.2(a)(3) of the Rules of Professional Conduct prohibits us from advertising specific or cumulative case results without a disclaimer that puts the case results in a context that is not misleading.
Since every case has different facts, a list of victories is always misleading unless we present all the facts and circumstances of the case in detail. (And, if we listed victories without our losses, it would be doubly misleading). At Braden & Tucci , we will not mislead people into choosing us as their lawyers.
